How ADA Protects the Employment Rights of People with Disabilities

If a person with a disability believes that an employer has discriminated against them based on their disability, they can file a claim with the U.S. Equal Employment Opportunity Commission (EEOC) or their state fair employment practice agency. A person must file a charge with EEOC within 180 days of the discrimination occurring. A person can file a charge online through EEOC’s public portal. They have to register first, however. If a person with a disability is filing a charge with their state or local government employment agency, they have to do it within 300 days of the discrimination occurring.

Once EEOC receives a charge, it will review it. If the charge is untimely, impossible to prove, or misaligned with the laws EEOC is empowered to enforce, it will close its investigation and notify the person who filed. In other instances, EEOC will send a notice of receipt to the employer within 10 days.

Depending on the circumstances, EEOC may refer the employer and employee to mediation. If EEOC does not refer parties to mediation or if mediation fails, it will ask the employer for a respondent position statement (the employee can view this response and reply to it). Afterward, EEOC will investigate the charge, sometimes even going to the workplace to interview relevant parties.

If investigations show that there was discrimination, EEOC will encourage voluntary settlement between the two. If this fails, it will issue the employee a Notice of Right to Sue the employer in court. If it cannot determine whether there was discrimination, it can also issue the Notice of Right to Sue.
